End User License Agreement — Echoes of the Eight Realms

LICENSE

Subject to the Terms of Service (xceptionmobile.com/echoes/terms), Xception Mobile LLC grants you a limited, personal, non-exclusive, non-transferable license to install and use Echoes of the Eight Realms for non-commercial entertainment on devices you own or control, consistent with applicable app-store rules. The Game is licensed, not sold.

RESTRICTIONS

Except where applicable law permits otherwise, you may not copy or redistribute the Game, sell or sublicense access, circumvent security controls, use modified clients or automated gameplay, or exploit errors to obtain an unfair advantage. This does not restrict rights to interoperability, security research, or other activities protected by law.

UPDATES AND SERVICES

The Game may require an internet connection and updates to continue working. Updates may alter features or balance. We may correct erroneous server records or duplicated items after investigating an error or exploit, while respecting legitimate purchases and applicable consumer rights.

OWNERSHIP AND TERMINATION

All rights not expressly granted remain with Xception Mobile LLC and its licensors. We may suspend or terminate access for a material violation of the Terms, subject to applicable law. You may delete your account as described on the account deletion page (xceptionmobile.com/delete-account). Data handling is explained in the Privacy Policy (xceptionmobile.com/privacy).

PLATFORM TERMS AND CONTACT

This agreement is between you and Xception Mobile LLC, not Apple or Google. Applicable platform terms may also apply. Questions: support@xceptionmobile.com.

ADDITIONAL TERMS FOR APPLE DEVICES

If you downloaded the Game from the Apple App Store:

• Acknowledgement. This agreement is between you and Xception Mobile LLC only, not Apple. Xception Mobile LLC, not Apple, is solely responsible for the Game and its content.

• Scope of license. Your license is limited to using the Game on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

• Maintenance and support. Xception Mobile LLC is solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for the Game.

• Warranty. If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Game. To the maximum extent permitted by law, Apple has no other warranty obligation for the Game; any other claims, losses, liabilities, damages, costs or expenses from any failure to conform to a warranty are Xception Mobile LLC's responsibility, to the extent not disclaimed.

• Product claims. Xception Mobile LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the Game or your use of it, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.

• Intellectual property. If a third party claims that the Game or your use of it infringes their intellectual property rights, Xception Mobile LLC, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.

• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

• Developer contact. Xception Mobile LLC, 63 Appleton St., Malden, MA 02148, USA, support@xceptionmobile.com.

• Third-party terms. You must comply with applicable third-party terms (for example, your wireless data agreement) when using the Game.

• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this agreement and, once you accept it, have the right to enforce it against you as a third-party beneficiary.
